Kimberly Friend, According To Police, Refuses Breath Test, Says “You’re Going To Arrest Me For A .13.”

DELRAY BEACH, FL (BocaNewsNow.com) (Copyright © 2021 MetroDesk Media, LLC) — Boca Raton resident Kimberly Friend allegedly told a Delray Beach Police officer that, “you don’t know that I’m drunk,” and “that’s how I normally smell,” as the officer conducted a DUI investigation after Friend was found sound asleep in her car.
According to a police report obtained by BocaNewsNow.com, an officer sat and watched a traffic light at South Federal Highway and East Linton Blvd. change three times while Friend slept in her vehicle in the street. Friend was allegedly driving a black Honda SUV with a license plate that was — apparently — unmistakably hers: FRI3ND.
From the police report:
“I arrived on scene and positioned my vehicle directly in front of and almost touching the Honda. From this position I observed a white female with blond hair, later identified as Kimberly Friend, asleep and unaware in the drivers seat. I approached the passenger side window as Friend woke up and she was unaware that she had fallen asleep. Friend advised that she was coming from a friend’s house and heading home.
Friend was very talkative and friendly. I walked over to the drivers side window to better observe Friend and immediately detected the odor of an unknown alcoholic beverage. I aslo noticed that Friend had glossy eyes and her speech was slurred. Friend admitted to drinking two vodka and soda drinks between 1130pm and 330am. Friend exited the vehicle and remained very talkative but stated that she did not feel the effects of alcohol. As Friend
spoke the odor became stronger.
Based on these observations, I requested Friend submit to the Standardized Field Sobriety Tasks. Friend immediately refused. I advised Friend that the tasks are designed to dispell my suspicion that she may be impaired and that if she refused to do the tasks, I would have to base my decision to arrest on the information known to that point. Additionally, I advised Friend that a refusal to do the tasks could be used against her in court. I then requested Friend perform the tasks again, and she again refused. Friend was hadncuffed behind the back and secured in the prisoner compartment of my patrol vehicle. I collected Friend’s cell phone and wallet from her vehicle as her personal property. The vehicle was inventoried and towed by Westway towing.
As Friend was put into the vehicle, she jokingly stated “you don’t know that I’m drunk” and “that’s
how I normally smell”.
I transported Friend to the Breath Alcohol Testing Facility at the Palm Beach
County Jail. On the way, Friend made several statements indicating that she refused to perform the Standardized Field Sobriety Tasks because she was over the limit. At one point Friend stated, “you’re going to arrest me for a .13”.
Kimberly Friend, of the 20900 block of Certosa Terrace in Boca Raton, was booked into jail Thursday and charged with DUI. She was separately ticketed for stopping illegally on a crosswalk. She was released several hours later on her own recognizance.
A court date is pending.
